Supreme Court puts on Hold 25-Year Age Bar for 2017 NEET Aspirants

On Friday the Supreme Court has put the regulation limiting the age of aspirants appearing for the National Eligibility cum Entrance Test i.e. NEET 2017 on hold and said that all the candidates can fill the form for medical entrance exam till 5th April 2017 irrespective of their age. A bench led by Justice Dipak Misra said that the notice regarding the age limit cannot be determined based on the instructions by the Medical Council of India (MCI) and that the aspiring candidates will be allowed to fill the form of CBSE’s online portal on or before April 5.

A petition was filed by some medical aspirants who alleged that the age limit was imposed by the MCI without any regulation to foist such a condition. The petitioners also pointed that by putting an age bar through just notice and ignoring the need for formally issue a regulation, the MCI had overreached its authority. The bench held a prima facie that without formally issuing an appropriate regulation formally, the regulators could not cap the age.

While the MCI maintained its authority, the courts said that it was exigent to extend the deadline for filling the application form to April 5 from earlier mentioned date of March 1 for the candidates wishing to fill the form and are above 25 years of age. The bench fixed the date for a detailed hearing in the month of July while it restrained the High Court to entertain the litigations pertaining to the allocation of exam centres.
