The Forest Rights Act, 2006 restored deprived forest rights (both individual and community) of traditional forest dwellers across India.

Statement 1 is correct: The act stated that no forest dwelling tribe member or other traditional forest dwellers shall be evicted or removed from the forest land under his control till the verification process is not completed.

Statement 2 is correct: The act recognized forest rights of traditional forest dwellers provided they have resided for at least three generations before to 13/12/2005 and have relied on the forest or forest land for bonafide livelihood. (A generation for this purpose would mean 25 years).

Statement 3 is incorrect: It also stated that rights conferred shall be heritable but not alienable or transferable.

UPSC asks questions on contemporary laws, schemes and initiatives taken by the government for the welfare of Tribals, Scheduled Castes, Forest dwellers etc.

This question can be solved by using conceptual clarity. If we see all three statements, in statement 3 it is given that the rights given are transferable. If they are transferable then the tribal and forest dwellers can be exploited by the outsiders, which will lead to their marginalization. This goes against the tip Grassroot prism, which says most of the government interventions are targeted towards the vulnerable section or sectors which need upliftment or improvement. Hence, it can not be the provision of the act as it is disempowering the tribal and forest dwellers. Therefore, statement 3 must be wrong and we can eliminate it. And eliminating it will leave us with only one option i.e. (a).
