Statement 1 is incorrect: As per the Protection of Plant Variety and Farmers Rights Act, 2001 Section 45, “National Gene Fund” has been constituted to receive (or give) contributions from the Breeder will have to pay royalty which will go to the National Gene Fund.

Statement 2 is correct: Following are the ways in which contribution to the Gene Fund can be received:

  • The benefit sharing received from the breeder of a variety or an essentially derived variety registered under this Act or propagating material of such variety or essentially derived variety, as the case may be;
  • The annual fee payable to the authority by way of royalty under subsection (1) of section 35;
  • The compensation deposited in the Gene Fund under sub-section (4) of section 41;
  • The contribution from any national and international organisation and other sources.

Statement 3 is correct: The farmer who is engaged in the conservation of genetic resources of land races and wild relatives of economic plants and their improvement through selection and preservation shall be entitled in the prescribed manner for recognition and reward from the National Gene Fund; Provided that material so selected and preserved has been used as donors of genes in varieties registrable under this Act.

Additional Information:

Seed varieties cannot be patented in India. The Protection of Plant Varieties and Farmers’ Rights (PPV&FR) Act allows protection of plant varieties for some years if they are found to be distinct, uniform and stable. India is the only country which has provided for the farmers to use, multiply, share informally or sell formally any protected variety, as long as they do not brand it and sell it. But if farmers brand and sell seeds that are under PPV&FR protection then it is an offence. This last clause was used by PespiCo to sue farmers recently.

The farmers requested the government to interfere on their behalf and ask Protection of Plant Varieties and Farmers’ Rights Authority (PPV&FRA) to make a submission in court and fund legal costs through the National Gene Fund.
