Every Candidate has to deposit security amount on the filing of nomination paper if it is found to be valid. Representation of People Act, 1951 provides for conditions for the return of deposits:
If candidate's nomination is rejected or after acceptance of nomination he withdrew his candidature;
If he dies before starting of polls;
If he gets elected;
If he secures more than 1/6 of a total number of valid votes, though he lost the election. Securing of "more than" 1/6 of total votes is mandatory for return on this condition.
