Right to Property was a part of fundamental rights in Part-3 of the Indian Constitution.
The 44th Amendment Act of 1978 deleted the Right To Property by repealing article19(1) (f) and Article 31.
Article. 19 (1) (f) ensures that any person’s right against his property remains protected.
Article 31, on the other hand, guarantees the right to private ownership and the right to enjoy and dispose of property, free of restrictions.
Article 300A was added to the constitution in Part 12, under the ‘Right To Property.
The status of the Right To Property was then changed from the Fundamental Right to Legal Right. It does not belong to the basic structure of the constitution as well.
Important rights related to the property are:
- The right of possession
- The right of control
- The right of exclusion
- The right to derive income
- The right of disposition
