Who gives advice to the President of India?

Here is a list of matters on which the President of India is advised:

  • The Prime Minister advises the president with regard to the appointment of important officials like attorney general of India, Comptroller and Auditor General of India, chairman and members of the Union Public Service Commission (UPSC), election commissioners, chairman and members of the finance commission and so on. 
  • Article 74 says that there shall be a council of ministers with the Prime minister at the head to aid and advise the President, who shall, in the exercise of his functions, act in accordance with such advice. However, the President may require the council of ministers to reconsider such advice and the President shall act in accordance with the advice tendered after such reconsideration. 
  • The President appoints the other ministers on the advice of the Prime Minister [Article 75]. 
  • The president can seek advice from the Supreme court on any question of law or fact. However, the advice tendered by the Supreme Court is not binding on the President.
