1. Why do judges recuse themselves?

Mains: Recusal of judges – Meaning, guiding principles, procedure, and various issues associated with it.
Context
- Justice M.R. Shah, who is a Supreme Court judge, recently refused to recuse himself from hearing a plea by former Indian Police Service (IPS) officer Sanjiv Bhatt to submit additional evidence to back his Gujarat High Court appeal against his conviction in a 1990 custodial death case.Β
- The Chief Justice of India D.Y Chandrachud also refused to recuse himself from hearing petitions seeking legal recognition of same-sex marriages.
Recusal of judges
- Recusal refers to the withdrawal of a judge from hearing a case in order to prevent the perception that the judge was biased while deciding a case or avoid a potential conflict of interest.
- There can be various reasons for the recusal of judges such as a judge could be holding shares in a litigant company or the judge might be having personal association with one of the parties of a case or if an appeal is filed in the Supreme Court against a High Court judgment delivered by the judge concerned before his elevation.
Guiding principles and legislation
- The practice of judicial recusal derives its origin from the fundamental principle of βdue process of lawβ.
- Nemo judex in sua causa is one of the key principles of due process of law.
- Nemo judex in sua causa means βno person shall be a judge in his own caseβ.
- Further, the then Lord Chief Justice of England in his judgement in the Rex v/s Sussex Justices case (1924) had held that βjustice must not only be done but must also be seen to be doneβ.
- Judges, while taking the oath of office, promise to perform their duties βwithout fear or favour, affection or ill-willβ as per the Third Schedule of the Constitution.
- Additionally, the Restatement of the Values of Judicial Life adopted by the Supreme Court bars a judge from deciding a case that involves an entity where the judge holds pecuniary interest unless the parties concerned clarify that they have no objections.
Procedure for recusal
- There are mainly two types of recusals:
- An automatic recusal is when a judge voluntarily recuses himself from a case.
- A party involved in a case raises a plea for the recusal of a judge by highlighting the possibility of bias or conflict of interest of the judge.
- It is to be noted that a decision of recusal rests only on the conscience and discretion of the judge and no party can force or compel a judge to recuse himself from a case.Β
- There have been various instances in the past where judges have withdrawn themselves despite not seeing a conflict but only because such apprehension was cast.
- However, there have also been several instances where judges have refused to withdraw from a case.Β
- Whenever a judge recuses himself from a case, that case would be listed before the Chief Justice for allotment to an alternate Bench.
- India has no codified rules governing recusals but various Supreme Court judgments have dealt with the issue in the past.
- As there are no statutory provisions that govern the process, it is left to the judges to record reasons for recusals. Judges have sometimes specified reasons orally in open court and sometimes have recorded reasons through written orders.
- In its recent ruling, the Delhi High Court has held that βno litigant or a third party has any right to intervene, comment or enquire regarding a judgeβs recusal from a caseβ.
- Five judges of the Bombay High Court had recused themselves from hearing the Bhima Koregaon case.Β
- Supreme Court judge Justice Bela M. Trivedi had recused herself from hearing Bilkis Banoβs plea.
- In the Novartis AG v/s Union of India case, Justice Markandey Katju had withdrawn his name from the case.
- Additional Sessions Judge Arul Varma recused himself from the Jamia Millia Islamia violence case (2019).
Supreme Court on judicial recusal
- The Supreme Court has listed several factors that need to be taken into account for deciding the impartiality of a judge.Β
- In Ranjit Thakur v/s Union of India Judgement (1987), the apex court had said while determining if a judge should recuse himself from a case, the reasonableness of the apprehension of bias in the mind of the concerned party must be relevant.
- The judge should not only think from his perspective but also look at the mind of the party before him.
- The Supreme Court in its State of West Bengal v/s Shivananda Pathak Judgement (1998), defined judicial bias as a βpreconceived opinion or predetermination to decide a case in a particular manner, so much so that such predisposition does not leave the mind open to convictionβ.Β
- This condition of preconceived opinion in the mind of the judge renders the judge incapable of impartiality in a case.
- In the Supreme Court Advocates-on-Record Association v/s the Union of India Judgement (2015), the Court formulated a more definite rule by observing that where a judge has a pecuniary interest, no further inquiry is needed as to whether there was a βreal dangerβ or βreasonable suspicionβ of bias.Β
- In order to ensure that the court is deciding in terms of possibility rather than the probability of bias, such cases require an inquiry, with the relevant test being the βreal dangerβ test which investigates the real danger of bias.
- Furthermore, Justice Arun Mishra in the Indore Development Authority v/s Manoharlal and Ors Judgement (2019), had noted that having a legal opinion alone does not invalidate a judge from being impartial.
- Justice Arun Mishra had said that a judge who had rendered a decision in a smaller combination is not disqualified from being part of a larger Bench to which a reference is made.Β
Practice ofΒ judicial recusals in foreign jurisdictions
- The U.S.: Unlike India, the U.S. has well-defined legislation on judicial recusals.
- Title 28 of the U.S. Code mentions various grounds for disqualification of a judge.
- Similar rules are also seen in the American Bar Associationβs Model Code of Judicial Conduct, which mentions three grounds for recusal namely financial/corporate interest, a case in which the judge was a material witness or a lawyer, and a relationship to a party.Β
- Judges can also recuse themselves voluntarily which is known as βsua sponte recusalsβ.
- The U.K.: The law on judicial recusals in the U.K. has evolved through various judicial pronouncements.Β
- In the case of R v/s Gough, the βreal dangerβ test was adopted as a standard for passing recusal orders.Β
- As per the test, the disqualification was made solely on substantive and tangible evidence which conclusively highlights the judicial bias or prejudice.Β
- As the βreal dangerβ test was criticised heavily, a new test was formulated in the Lawal v/s Northern Spirit Ltd case.
- The new standard laid down also looked into the likelihood of bias from the perspective of a fair-minded and reasonable observer.
- In the case of R v/s Gough, the βreal dangerβ test was adopted as a standard for passing recusal orders.Β

1. An ordinance, its constitutionality, and scrutiny

Context: The President of India recently exercised his ordinance-making powers to promulgate βThe Government of National Capital Territory of Delhi (Amendment) Ordinance, 2023β (Ordinance).
What is an ordinance?Β
- Article 123 of the Indian Constitution empowers the President to issue an ordinance when both or one of the houses of the parliament is not in session.Β
- The ordinance carries the same force of the law as other laws of the land.Β
- The ordinance must be ratified by both houses of the parliament within six weeks after the session has resumed.Β

Recent ordinance: Observation made by the courtΒ
- The recent ordinance issued by the government overruled the verdict of the apex court regarding the power vested in the NCT government for appointing key officials in the UT.
- The court held that under article 239 AA 3(a), the Legislative Assembly of Delhi has power over lists 2 and 3 except for entries 1, 2 and 18.Β
- The court held that NCTD has the legislative power in all matters and the central government has the power to legislate with respect to land, police, and law and order.Β
- Thus, the court held the power with respect to βservicesβ is exclusively exercised by the government of Delhi.Β
- This above verdict has been negated by the Union government with the subsequent promulgation of the ordinance.Β

Previous judgment of the court:Β
- In Krishna Kumar Singh Vs State of Bihar, the apex court held that the satisfaction of the President is not immune from judicial scrutiny.Β
- The power exercised by the President under Article 123 is not parallel to the power vested in the legislature of the country.Β
- So the court can look into the material evidence of the act and thus take measures in order to uphold constitutional sovereignty.Β

Context
The head of Russiaβs Wagner group has said that his troops have captured the city of Bakhmut and have started transferring their positions to the Russian military.
Battle for Bakhmut
- Bakhmut is a city in eastern Ukraine.Β
- It is an administrative centre and an industrial hub in the Bakhmut Raion of Donetsk region.
- The city is located close to the Bakhmutka River.
- The battle for Bakhmut has continued for about a year as Russia invaded Ukraine on February 24, 2022.
- The founder and the head of Russia’s Wagner mercenary group claimed to have captured Bakhmut and has vowed to transfer control of the Ukrainian city of Bakhmut to the Russian army by 1 June 2023.
- The Russians already control the whole of Luhansk and capturing Bakhmut would potentially help them target other major urban centres in Donetsk such as Kramatorsk and Sloviansk.
- Ukraine, however, has denied claims that Bakhmut has been captured by Russia, and says that it still controlled a βmicro districtβ of the ruined city and is advancing on the flanks.

Following the death of three cheetah cubs in a span of one week, the Central government has appointed a new steering committee to oversee the implementation of Project Cheetah.Β Β
Details:
- The ambitious Project Cheetah has suffered a setback as three out of four cubs born in Kuno National Park in Madhya Pradesh have died.
- These cubs were born to a translocated Namibian cheetah at the Kuno National Park in Madhya Pradesh in March 2023.
- Experts believe that the extreme heat and the lack of adequate nutrition might have contributed to the death.
- Furthermore, three adult cheetahs have also died to date since 20 of the animals were relocated from Namibia and South Africa to Kuno National Park.
Rajesh Gopal Committee
- An 11-member committee, headed by Dr. Rajesh Gopal, secretary-general of Global Tiger Forum and former India Forest Service officer closely associated with Project Tiger, has been formed to oversee the implementation of Project Cheetah.
- This committee also comprises other national and international experts.
- The key mandate of the committee is:
- To monitor the progress of the cheetah reintroduction programme.
- Advise the Madhya Pradesh Forest Department and the National Tiger Conservation Authority to decide on opening up the cheetah habitat for eco-tourism.
- Recommend regulations in this regard and ways to involve the local community in the project activities.
- The Cheetah Project Steering Committee will be in force for two years.
- The Committee is required to convene at least one meeting every month and conduct field visits to the Kuno National Park.

1. All-in-one policy plan to spread insurance in India
- The Insurance Regulatory and Development Authority (IRDA) is coming up with a new affordable bundled product that extends protection to citizens against multiple risks.
- The new all-in-one policy also aims to expedite claim settlements by linking death registries onto a common industry platform.
- Once this new policy is launched, households across the country would get an affordable single policy that covers health, life, property and accident which also gets their claims settled within hours.
- These initiatives are part of a broader overhaul that includes legislative amendments to attract more investments and make the insurance sector βavailable, affordable and accessibleβ to all citizens.
- According to IRDA, these changes could double the number of jobs in the sector to 1.2 crore.
- A βUPI-like momentβ is being planned for the insurance sector through βBima Trinityβ which includes:
- Bima Sugam – a platform to integrate insurers and distributors onto one platform to make it a one-stop shop for customers.
- Bima Vistar – covers a bundled risk cover for life, health, property and casualties or accidents.
- Bima Vaahaks – women-centric workforce in each Gram Sabha that will meet the women heads of each household to spread awareness about composite insurance products such as Bima Vistar.
2. China constructing model villages opposite the LAC
- As per various reports, China is continuing to expand the network of model villages, or Xiaokang (moderately prosperous) villages, opposite the Line of Actual Control (LAC) in the Middle and Eastern sectors.
- It is said that the Chinese are constructing villages at a rapid pace opposite Barahoti. The patrols of the Peopleβs Liberation Army have been observed every 15 days as against once in a season earlier.
- Such patrols are seen in the Mana, Neeti and Thangla areas.
- Reports suggest that several Xiaokang villages are under construction all along the LAC, including at the Chumbi valley facing the strategically crucial Siliguri corridor.
- Construction of border settlement villages is seen northwest of Tholing and opposite the Kameng area in Arunachal Pradesh.
- Two villages have been constructed in Cuna country with about 200 inhabitants from the Menba ethnic community.
- The Indian Army, in recent years, has signed various agreements for the procurement of high-technology equipment considering the expansion of infrastructure by China.
- Further, new autonomous vehicles will soon replace animal transport for transporting rations and utilities to soldiers in forward locations and snow scooters, laser dazzlers and new-generation sniper rifles have also been inducted.

3. Chinese hackers attacking infrastructure, warns U.S.
- The US State Department and Microsoft have warned Chinese hackers attacking ‘critical’ infrastructure.
- It has been seen that state-sponsored Chinese hackers have infiltrated critical U.S. infrastructure networks and its Western allies.
- Microsoft has highlighted that Guam, a U.S. territory in the Pacific Ocean with a vital military outpost, has been one of the targets.
- Microsoft further noted that the stealthy attack carried out by a China-sponsored actor named βVolt Typhoonβ since mid-2021 has enabled long-term espionage and was likely aimed at hampering the U.S.
- China, however, has denied the allegations, and has said that the Microsoft report was βextremely unprofessionalβ and βscissors-and-paste workβ.
- The Chinese Foreign Ministry said that βIt is clear that this is a collective disinformation campaign of the Five Eyes coalition countries, initiated by the U.S. for its geopolitical purposesβ.
