Chapter 2: Public Service Commissions
When and how members of Public Service Commission can be removed (Art.317)
The chairman or any other member of a Public Service Commission can be removed from his office by an order of the president only on the ground of misbehaviour, after the Supreme Court (on reference being made to it by the president )has, on inquiry, reported that he should be removed. The President may, in the meanwhile, suspend such member.
Misbehaviour includes:
1. being concerned or interested in any contract or agreement made by or on behalf of the Government of India are the Government of a state; or
2. participating in the profit thereof or in any benefit or employment arising there from, otherwise than as a member and incommon with the other members of an incorporated company.
The president may, of his own motion, remove the chairman or member if he -
(a) is adjudged as insolvent or (b) engages during his term of office in any paid employment outside the duties of his office or (c) is, in the opinion of the president, unfit to continue in office by reason of infirmity of Mind or body.
