All India Judicial Services was inserted into Article 312 by the Constitution (Forty-second Amendment) Act, 1976. The idea was first mooted by the Law Commission in the 1950s to have an All-India Judicial Services. It has been endorsed and recommended by the Parliamentary Standing Committee, first National Judicial Pay Commission and the National Advisory Council. It shall not include any post inferior to that of a District Judge. Article 312 in the Indian Constitution provides that if Rajya Sabha passes a resolution with special majority (not less than two thirds of the members present and voting), a new all India services can be created by passing a law.
