differentiate between appellate and advisory jurisdiction

Open in App
Solution

Dear student
  1. Appellate - means you can approach the SC only when there is provision of appeal against an order given by lower court,if there is no such provision then you can`t approach the higher court i.e you can`t appeal.
  2. Advisory - under art.143 of indian constitution there are certain instances where the President of India needs certain advises from SC it might be discretionary or obligatory. if President asks for advise from SC o any question of law or fact of public importance which had arisen or which is likely to arise then SC can deny to give advise but if any dispute arising out of any pre-constitution treaty, agreement, covenant, engagement, sanad or other similar instruments then SC is bound to give the advise.
