Question

Distinguish between a flexible constitution and a rigid constitution.

Open in App
Solution

The flexible constitution is when the constitution can be amended, repealed or altered by the same procedure as that of ordinary law. this tends to place the constitutional law and ordinary law on the same level in the sense that both are enacted in the same way and proceed from the same source. That is there is no specific procedure to bring changes in the constitution.
Whereas a rigid constitution possesses higher sanctity and special status. It tends to stand above the ordinary law and there is a procedural difference in bringing about changes in the constitution and ordinary law. The powers of the legislature are limited by the constitution itself Wherever a statutory law doesn't conform with the constitutional law it becomes ultra vires and nonoperational and doesn't become operative
