Dear Student,
Has justice been achieved in true sense of the word in Indian society and polity, is a very debatable statement.
a. In a diverse and complex country like India with competing claims, it is often difficult to pacify varied sections of the society.
b. Further, there may be many groups who may feel neglected, marginalised, oppressed and may argue for justice.
c. Justice itself is a very elusive term as just attitude towards one section may be unjust towards another.
d. Therefore following a middle path and resolving conflict among groups is not an easy task.
e. Further, it is often said that Justice delayed is justice denied because of large number of cases pending in the courts.
f. There are a certain constraints on the judiciary as a case is nit decided overnight and abruptly, it requires proper investigation and has to undergo lot of proceedings before the justice is delivered.
g. Further, delays are not a deliberate action by judicial system but pragmatic necessity at times to ensure that guilty is punished and innocent are freed.
h. Further Justice delayed does not imply that justice was not delivered. it was very much served and law took its own course.
i. Justice rather was delivered after thorough deliberation and not in a haste manner.
j. Though we may favour speedy trail, one also has to ensure that spontaneous justice must be in the best interest of the innocent.
