As per Section 408 of the Companies Act, 2013, the Central Government shall constitute the National Company Law Tribunal (NCLT), the Tribunal will exercise and discharge the powers and functions as described under the Companies Act, 2013 or any other law for the time being in force. The Tribunal should be consists of a President and a such number of other Judicial and Technical Members as may be prescribed and the President will be the head of the NCLT. The appointment of President shall be done by the Central Government after consultation with the Chief Justice of India. Only a person who is or has been a judge of a High Court for five years is eligible to be appointed as president of the NCLT.
