how difficult it is to bring change in the constitution in a federal state
In a federal state it is difficult to bring about changes in the Constitution that effects the power sharing arrangement between the centre and the State.
a. Any changes in the power structure between the Center and the State requires special majority of the parliament and ratification by half of the the state legislature.
b. Since the amendment aims to modify any article related to distribution of powers between the central government and the states, it is necessary that states must be consulted and give their consent.
c. Therefore, any changes in the distribution of powers between the centre and the state requires to be passed by the Union Parliament with 2/3rd majority of both the houses separately and requires ratification of half of the state legislatures by simple majority before an amendment comes into effect.
d. The consent of the state government is sought to ensure that constitution is not easily arm twisted by political parties for their narrow political gains.
