Question

if empty set is a subset of every set as it is emty then why when contained within brackets the set is non-empty i.e. if it is empty then how can that set be a set?

First you should know that empty set is represented as ϕ but when we take it as, ϕ then this is not empty set as When we are writing ϕ then it is internationally known as empty set but ϕ is not because it is now containing a element that is ϕ but not in the sense of empty set but as a value like φ ,σ ,ε ,η,... means a element.
