Statement 1 is correct. Article 123 of the Indian constitution empowers the President to promulgate ordinances during the recess of Parliament. It is the legislative power of the President and the ordinances issued by him will have the same force and effect as an act of Parliament.
Statement 2 is incorrect. Ordinances issued by the President can be withdrawn by the President at any time. However, this power is not a discretionary power. He can promulgate or withdraw an ordinance only on the advice of the council of ministers headed by the prime minister.
Statement 3 is correct. The provision that the ordinance making decision of the President as final which was added by the 38th Constitutional Amendment Act of 1975 was deleted by the 44th Constitutional Amendment Act of 1978.
