The returning officer for the elections of the President and vice president is Secretary General of lok Sabha or the Secretary General of Rajya sabha on a rotational basis, in accordance with the provisions of the Constitution and the Presidential and vice-Presidential Elections Act, 1952. The said Act is supplemented by the provisions of the Presidential and Vice-Presidential Elections Rules, 1974, and the said Act under Rules form a complete Code regulating all aspects of conduct of elections to the Office of the President By convention, the Secretary General, Lok Sabha or the Secretary General, Rajya Sabha is appointed as the Returning Officer, by rotation. Two other senior officers of the Lok Sabha/ Rajya Sabha Secretariat and the Secretaries and one more senior officer of Legislative Assemblies of all States including NCT of Delhi and Union Territory of Puducherry, are also appointed as Assistant Returning Officers. The Election Commission of India makes such appointments.

राष्ट्रपति और उपराष्ट्रपति चुनावों के लिए रिटर्निंग ऑफिसर लोक सभा या राज्यसभा के महासचिव रोटेशन के आधार पर संविधान में वर्णित राष्ट्रपति और उप-राष्ट्रपति चुनाव अधिनियम, 1952 के प्रावधानों के अनुसार नियुक्त होते हैं ।उक्त अधिनियम राष्ट्रपति और उप-राष्ट्रपति चुनाव नियम, 1974 के प्रावधानों का पूरक है और नियमों के तहत उक्त अधिनियम एक पूर्ण संहिता बनाता है जो राष्ट्रपति के कार्यालय के चुनाव के सभी पहलुओं को नियंत्रित करता है। अधिवेशन द्वारा,लोकसभा महासचिव, या राज्य सभा महासचिव, को रोटेशन द्वारा रिटर्निंग अधिकारी के रूप में नियुक्त किया जाता है।

लोकसभा / राज्यसभा सचिवालय के दो अन्य वरिष्ठ अधिकारियों एवं सचिवों,दिल्ली और केंद्र शासित प्रदेश पुडुचेरी के अतिरिक्त सभी राज्यों की विधानसभाओं के एक वरिष्ठ अधिकारी को भी सहायक रिटर्निंग अधिकारी के रूप में नियुक्त किया जाता है।
