The prime ministercan be a member of the Loksabha or the Rajyasabha. He must become a member of either of the houses within six months if he is not a member at the time of his selection as prime minister.

The size ofunion council of ministers shall not exceed15% of total number of members of the loksabha.

Since prime minister is the head of the council of ministers, the other ministers cannot function when the prime ministers office become vacant( re-signs or dies etc). In other words, the council of ministers automatically dissolves and thereby generates a vacuum.However, The resignation or death of any other minister merely creates a vacancy.
