The Supreme Court can act as an advisor for the President in some instances. When the Indian subcontinent was partitioned, boundaries were drawn to delineate territories. There was an area called ‘Berubari’ in the Cooch Behar district of West Bengal. It was treated as part of India. There was some dispute about this territory, and it was finally agreed that half of Berubari needed to be transferred to East Pakistan. In this case, the President consulted the Supreme Court. And the court directed that the Constitution should be amended such that this territory could be transferred.
