Article 31 of the Constitution had earlier empowered the citizens of India to purchase, hold and dispose of movable as well as immovable property as a Fundamental Right. However, in keeping with the socialistic philosophy of the Constitution, the Right to property was deleted from the list of Fundamental Rights by the 44th Amendment Act 1978. This amendment made the Right to Property (Article 300 A) a legal right.
