At first the Chief Justice, after consulting other senior Judges, submits a recommendation to the Union Minister of Law. For appointing a Supreme Court Judge, the Union Minister of Law, directly submits a proposal to the Prime Minister. Whereas, at the level of the High Court, the Law Minister first consults the concerned State Government. After receiving the proposal of the Law Minister, the Prime Minister then advises the President. It is the President who formally appoints the Judge.
