Fundamental rights are that group of rights which are identified by the constitution to give ultimate protection to the citizens from any kind of government encroachment. With all the six fundamental rights like freedom of expression, religious and cultural freedom, equality before the law, freedom of assembly, etc. the right to constitutional remedies is considered as ‘the heart and soul’ of the Indian constitution. To enforce the fundamental rights, the right to constitutional remedies plays a major role because when any of the fundamental rights are violated, the citizens of India can seek remedy through approaching directly to the Supreme Court or the High court. For this reason, the right to constitutional remedies is called the most fundamental of all the fundamental rights.
