Question

Why was public interest litigation devised by the Supreme Court?

Open in App
Solution

Instructions:
Explain how PIL increased a common person’s or organisation’s access to justice.

Solution:
Everyone has the right to go to court in order to seek justice. But in reality, for a poor family, who can not read and whose family depends upon daily wage, going to court is not possible because it takes a lot of money, time and paperwork.

To find a solution to this, the Supreme Court in the early 1980s devised a mechanism of Public Interest Litigation or PIL to increase access to justice. It allowed any individual or organisation to file a PIL in the High Court or the Supreme Court on behalf of those whose rights are being violated.
