The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 seeks to recognize and vest the forest rights and occupation in forest land in forest dwelling scheduled tribes and other traditional forest dwellers who have been residing in such forests for generations but chose rights on ancestral lands and their habitat were not adequately recognized in the consolidation of state forests during the colonial period as well as in independent India resulting in historical injustice to them. The Act has been notified for operation with effect from December 31, 2007.

As per the Act, the responsibility for recognition and vesting of forest rights and distribution of land rights rests with the state government.

आदिवासी लोगों के तेजी से सामाजिक-आर्थिक विकास के लिए 1972 में शिक्षा और समाज कल्याण मंत्रालय द्वारा गठित एक विशेषज्ञ समिति द्वारा वर्तमान जनजातीय उप योजना (टीएसपी) रणनीति विकसित की गई थी, जिसे पांचवीं पंचवर्षीय योजना में पहली बार अपनाया गया था।

अनुसूचित जनजाति और अन्य पारंपरिक वन निवासी (वन अधिकारों की मान्यता) अधिनियम, 2006 वन निवास अनुसूचित जनजातियों और अन्य पारंपरिक वनवासियों में वन भूमि में वन अधिकारों और कब्जे को मान्यता देने और निहित करने का प्रयास करता है जो पीढ़ियों से ऐसे जंगलों में निवास कर रहे हैं। लेकिन पैतृक भूमि पर उनके अधिकारों को और उनके निवास स्थान को औपनिवेशिक काल के दौरान और साथ ही स्वतंत्र पश्चात भारत में राज्य के जंगलों के समेकन में पर्याप्त रूप से मान्यता नहीं दी गई, जिसके परिणामस्वरूप उनके साथ ऐतिहासिक अन्याय हुआ। इस अधिनियम को 31 दिसंबर, 2007 से कार्यान्वयन के लिए अधिसूचित किया गया है।

अधिनियम के अनुसार, वन अधिकारों को मान्यता देने और निहित करने और भूमि अधिकारों के वितरण की जिम्मेदारी राज्य सरकार के पास होती है।
