Under Article 324(2) of the Constitution of India, the President of India is empowered to appoint the Chief Election Commissioner and the Election Commissioners

Both CEC and other ECs enjoy equality in tenure. The Chief Election Commissioner or an Election Commissioner holds office for a term of six years from the date on which he assumes his office. Both Chief Election Commissioner and other Election Commissioners shall vacate the office when attain the age of sixty-five even years before the expiry of the said term of six years.
