As the students who are sitting in the positions numbered by the prime numbers get Dairy Milk, we have to first know the number of prime numbers from 1 to 40.
The prime numbers are 2, 3, 5, 7, 11, 13, 17, 19, 23, 29, 31, 37. Clearly, we can see that there are 12 prime numbers, so 12 students will get Dairy Milk chocolates. The number 1 is not a prime number. 1 is neither a prime nor a composite number.
