According to the Prohibition of Child Marriage Act of 2006, a child is any person who, if male, is below the age of 21 years, and if female, is below the age of 18 years. If the marriage happens where either party is a child, it is defined as ‘Child Marriage’. According to this definition, both Shalini and Rajesh would be protected under the Child Marriage Act.

As per this law, if a male adult above eighteen years of age contracts a child marriage, he shall be punishable with rigorous imprisonment which may extend to two years or with fine which may extend to one lakh rupees or with both. This punishment is applicable for someone who directs or performs child marriage too. If the marriage is voided, then the adult male will pay the maintenance to the girl until her remarriage, that is, till she gets married again or she is 18 years of age. In case the groom is minor, then the amount will be paid by his family members.
