REFUND POLICY FOR BYJU’S TUITION CENTRES

At Think & Learn Private Limited (hereinafter “BYJU’S”/ “we”/ “our”/ “us”), we value the trust of our customers (“Customers”/ “you”/ “your”). In order to honour that trust, we have created this refund policy (“Policy”) to work in a transparent manner.

  1. Objective: The objective of this Policy is to ensure transparency in refund process & complete satisfaction of our Customers. This Policy enables that the refunds (if any) are processed in a fair manner.
  2. Scope: This Policy is applicable to processing of any refund of applicable fees paid by the Customers for enrolling their wards from Grade 4 to Grade 10 (“Students”) to such classroom courses as more particularly identified in the order form (“Order Form”) submitted by the Customer at the time of enrolling the Student in the respective course (hereinafter “Course”) under BYJU’S Tuition Centres (hereinafter “BTC”).
  3. Validity: This Policy shall come into effect from 22nd March 2023 and shall continue to remain valid until it is specifically replaced/ revoked by us. Any refund request, received from you on or after 22nd March 2023, will be processed in accordance with this Policy.
    1. Process for Requesting Refunds:
      1. Obligation of Customer: If a Customer wants to withdraw the admission from BTC, such Customer will be required to visit the respective branch/ centre of BTC in person, in which the Student is currently availing the Course (hereinafter “BTC Branch”) and submit the application for withdrawal/ refund, in writing (“Application”), stating the reasons for seeking such refund. The date of submission of the written Application (“Submission Date”) at the respective BTC Branch will be taken into consideration for the purpose of calculation of the refund amount. A refund request shall be considered valid only if the Application is submitted by the Customer, in person, at the relevant BTC Branch and any deviation from these requirements shall not be considered for refunds.
      2. Applicable Fees and Refunds:
        1. Registration Fee: Customer shall be required to pay upfront fees for registration (as more particularly mentioned in Table A hereunder) into the classroom courses under the BTC (“Registration Fee”). The Registration Fee shall be fully refundable in case of any Application received by the BTC Branch for withdrawal of admission by the Customer prior to completion of fourteen (14) calendar days from the Orientation Date (hereinafter “Registration Refund Period”). No Registration Fee shall be refunded to the Customer in case of any withdrawal of admission, for which, the Application is received by us at the respective BTC Branch after completion of the Registration Refund Period, as mentioned above.
        2. Tablet Charges: On payment of a specific fees as more particularly mentioned in the Order Form (hereinafter referred to as “Tablet Charges”), the Students shall be provided with our electronic handheld proprietary learning device (hereinafter “Tablet”) with preloaded study material for learning outside the classroom coaching. Post receipt of the Tablet Charges, the Tablet shall be given/ delivered to the Student. Such date when the Student receives the Tablet shall be considered the “Tablet Delivery Date”. Any refund for Tablet Charges will be calculated from the Tablet Delivery Date (excluding the Tablet Delivery Date in calculating the duration) to the Customer, as illustrated in the Table B below. The Tablet Charges shall be fully refundable only in such cases where the Tablet is returned by the Customer to the BTC Branch within fourteen (14) calendar days after the Tablet Delivery Date. Any request for return of Tablet – (i) with any damage, or (ii) received post completion of fourteen (14) calendar days after the Tablet Delivery Date, shall not be accepted by the BTC Branch and no refunds shall be provided to the Customer. In case of receipt of a damaged Tablet from the Customer, we will return it to the Customer without any refund of Tablet Charges. We will not be liable for any – (i) damage caused to the Tablet during the shipping process initiated by the Customer; or (ii) shipping charges borne by the Customer for returning the Tablet to us, pursuant to a refund request.
        3. Provided hereunder are certain key aspects that need to be taken into account for the purposes of calculation of refund amount.
          1. Orientation Date: Such date as specifically identified in the Order Form, when the Student is required to attend the orientation session for the Course.
          2. For the duration of the Course, quarters will be considered as: (a) April – June; (b) July – September; (c) October – December; (d) January – March, where each such quarterly period will be referred to as a “Quarter”.
          3. For claiming refunds of Registration Fees, Course Fee, Tablet Learning Program Fee and Tablet Charges (hereafter collectively referred to as “BTC Course Components”), as more particularly mentioned in the respective Order Form basis the services availed, please refer to Table A and Table B (as applicable) for understanding the scenarios detailed hereunder.
          4. The Quarter in which the Student was enrolled in Course will be used to calculate quarterly amounts till such Quarter in which the Submission Date occurs i.e., when the Application for withdrawal is submitted at the BTC Branch for claiming relevant refund, provided the Submission Date is no later than 60 (sixty) calendar days from the Orientation Date for the relevant Customers. Such 60 (sixty) calendar days period from the Orientation Date shall be referred to as “Refund Claim Period”.
          5. The actual Course Fee and Tablet Learning Program Fee, basis the amount paid by the Customer (as identified in the Order Form) for availing such services, shall be taken into consideration for pro-rata calculation of refunds (if any).
          6. With respect to any refunds pertaining to the Course, all Quarters between the Orientation Date and Submission Date (both included for calculation of quarters) will be calculated for arriving at the applicable deductions from the fees paid for the relevant Course. This principle pertaining to the deductions and calculation of the relevant refund fees shall be uniformly applicable to the Courses, unless specifically stated otherwise for specific courses, as more particularly identified in the Order Form (hereinafter referred to as “Other Courses“). For such Other Courses, the applicable Quarterly calculations stated herein will not apply AS-IS and shall apply as more particularly prescribed in the respective Order Form.

  4. Mode of Refund:

    1. No BTC Course Components will be refunded in cash. All applicable refunds shall be paid through cheques or online transfer ONLY, in the name and to the account of the Customer within a reasonable period of thirty (30) calendar days from the date on which a written confirmation is provided to the Customer for approval of such refund. Further, all refunds shall be processed in Indian Rupees only.
    2. In the event your payment instrument/ account through which original payment was made, is not active or does not support refunds, you shall be required to provide other bank account details belonging to you for processing the relevant refund. We shall not be held responsible and/ or accountable for crediting refund money to the wrong account due to incorrect details furnished by you. You shall be required to furnish a declaration for transfer of refund to another bank account in the format and manner as may be required by us.

  5. Important Terms & Conditions

    1. You represent and warrant that any information that is provided to our team at the BTC Centre or submitted in the Order Form and related documents for enrolling the Student in a Course, is accurate, true and current. Any deviation from this will result in immediate cancellation of Student’s enrolment with no refund thereof and the Course will not be resumed for such Student under any circumstances.
    2. If a Student is terminated from the Course on account of any disciplinary action taken against such Student, then we shall not be liable for any refunds to you. The decision of the BTC Area Business Head, in this regard will be final and binding on you. In any such cases, enrolment of the Student will be considered as cancelled and the Course will not be resumed for such Student under any circumstances.
    3. If due to a Force Majeure Event (as defined herein below), we have to discontinue a certain service that the Student has already availed as a part of the Course; then we are under no obligation to refund the fee for such portion of the service already availed by the Student. We are also not liable to provide any additional service in lieu of the service so discontinued.
    4. We and/or the BTC Branches shall be not be liable for any delay or failure to perform its obligations (in total or in part) if such delay or failure is due to any cause(s) including but not limited to, acts of God, strikes, lockouts, riots, lockdown, government restrictions, sanctions, wars, terrorism, insurrections, civil disturbances, earthquake, weather, fire, epidemic, pandemic, lockdown, explosions, and/or any other cause beyond our reasonable control making the performance of our obligations/ services inadvisable, commercially impracticable, illegal, or impossible (“Force Majeure Event“). We and/ or our BTC Branches shall not be held liable for not being able to hold the classes at the respective BTC Branch and that such classes may be held/conducted in online mode in the interim in compliance with the laws, rules and/or regulations as may be applicable under the law for time being in force. Accordingly, no refund shall be provided to you in such case. Also, in case classes may not be conducted in any mode (offline and/or online), or if running of the classes is prohibited as per the applicable laws, guidelines, regulations, during such period Force Majeure Event, then also no refund shall be applicable.
    5. In case a Customer has opted for any retention offers, by approving/ availing the retention offer extended by us during the validity of the respective Course, such Customers hereby duly acknowledge, confirm and agree that they shall not be eligible to apply for or avail any refunds under this Policy thereafter.
    6. This Policy shall not be applicable for such courses having a tenure of lesser than 03 (three) months (each such course a “Short-Term Course”). You hereby duly acknowledge, confirm and agree that purchase of any such Short-Term Courses, shall be FINAL, NON-CANCELLABLE, IRREVOCABLE and NON-REFUNDABLE. No refunds will be provided for any unused portion of respective Short-Term Courses in case of partial usage of services provided under such Short-Term Courses.
    7. Any other refund policy, mentioned anywhere on our website or any other place, does not hold true for the Courses offered under BTC. The refund terms for Courses offered under BTC, as mentioned under this Policy, shall supersede any other refund policy provided on the website or application.
    8. On account of withdrawal of admission by you, the services to be provided by us, from Submission Date up to completion of Course, shall be considered as services not performed. Accordingly, we will issue a GST credit note to you, which otherwise may not be issued if the withdrawal and issuance are beyond the timelines allowed under applicable law. In case the Submission Date is after the prescribed timeline, we may issue a commercial credit note, on your request.
    9. All the refunds shall be processed at the discretion of Byju’s. You hereby duly acknowledge, confirm and agree that the decision of Byju’s, for any refunds processed under this Policy, shall be FINAL and BINDING on you.
    10. Further, you undertake not to dispute the refund terms provided under this Policy by BYJU’S or raise any claims beyond the scope provided under this Policy.
  6. Changes to this Policy: We reserve the right to modify/ amend/ replace this Policy at any time, as deemed fit by us, without any prior notice to you.
