Who can remove the judges of the Supreme Court?

  • The judges of the Supreme Court are removed by the parliament.
  • There are two conditions for the removal of the judges of the Supreme Court:
    1. Proven misbehaviour
    2. Incapacity
    • Article 124(4) of the Indian Constitution deals with the removal of the judges of the Supreme Court. The word impeachment is used colloquially for removal, though it is not mentioned in the constitution. 
    • An order issued by the President, addressed in both houses of Parliament has to secure the support of;

    1 . The majority of the total membership of that house 

    2 . Majority of not less than two-thirds of the members present and voting. 

    • Once the motion is adopted in both houses of Parliament, it is presented to the President in the same session.
    • The procedure for removal of the judge is mentioned in the Judges Inquiry Act, 1968.
    • The Supreme Court of India consists of the Chief Justice and 30 judges. They retire at the age of 65.
    • The current Chief Justice of India is Justice Uday Umesh Lalit.
