MP High Court allowing non domiciles to sit for engineering service exam

Madhya Pradesh Public Service Commission

On May 18th, the Madhya Pradesh High Court ordered the MP Public Service Commission (MPPSC) to permit candidates from other states to appear in the engineering service exam-2021.

A bench including Justice S A Dharmadhikari and Justice Vishal Mishra asked MPPSC to change the application process and even push the last date of application if required.

The petitioner, Shailendra Singh, who is from Uttar Pradesh, challenged the notification issued on December 30, 2021. The Petitioners, who were students, filed the writ petition challenging the legality and validity of the gazette notification. The petitioners requested for a portal for Non-Domicile Category candidates to apply and for the examination date to be extended from 22.05.2022, to give a proper opportunity to Non-Domicile candidates.

The division bench of Justice S.A. Dharmadhikari and Justice Vishal Mishra asked MPPSC to make amendments on the portal and provide a Non-Domicile Category Candidates.

This is what the bench said, “In view of the aforesaid submissions made by learned counsel for the parties and with a view to provide equal opportunity to all concerned, it is directed that all the candidates not belonging to the State of Madhya Pradesh will be permitted to participate in the competitive examination in respect of State Engineering Services Examination, 2021 for which the Madhya Pradesh Public Service Commission shall make adequate amendment in the website and permit these candidates to fill up the application forms. If the need arises the Madhya Pradesh Public Service Commission shall consider and notify a new date for filling up the application forms giving them at least seven days’ further time to do the needful and thereafter notify a fresh date for conducting the examination.”
