Singapore Convention on Mediation [UPSC Notes]

International organisations and groupings are an important part of the International Relations section of the General Studies paper 2 in the IAS Exam.

Singapore Convention on Mediation 

The United Nations General Assembly adopted the United Nations Convention on International Settlement Agreements Resulting from Mediation, also known as the “Singapore Convention on Mediation” in December 2018.

  • It was declared open for signature in 2019 and Singapore hosted the signing ceremony. This is the first UN treaty to be named after Singapore.
  • The convention came into effect on 12th September 2020.
  • As of 1st September 2020, there are 53 signatories to the convention including China, the United States and India.
Mediation 

Mediation is considered a cost-effective, time-saving and less antagonistic way of resolving discords between parties. It encourages the parties to find common grounds for reaching a mutual agreement. In commercial disputes, it is considered to be an effective way to resolve disagreements between the parties as it maintains the confidentiality between the mediator and the two parties.

Singapore Convention on Mediation Significance

The convention aims to ease the cross-border dispute resolution mechanism via effective mediation for businesses. It provides a uniform and efficient framework for the enforcement of international settlement agreements resulting from mediation.

  • The convention ensures that a settlement reached by parties becomes binding and enforceable in accordance with a simplified and streamlined procedure.
  • The conventions would help in saving cost, and time and reaching a mutually acceptable solution which is the key feature of dispute resolution via mediation. 
  • It would facilitate international trade and commerce which leads to economic development.
  • The convention contributes to the development of a mature, rule-based global commercial system.

Singapore Convention (SC) Week 2022

The Singapore Convention Week was held in August – September 2022.

  • It was organised by the Singapore Ministry of Law in collaboration with partner organisations. It featured a week-long series of legal and dispute resolution-related events.
  • At the heart of the Singapore Convention was the UNCITRAL Academy which comprised the UNCITRAL Academy Conference and the UNCITRAL Academy Capacity-Building workshop jointly organised by the Singapore Law Ministry and the United Nations Commission on International Trade Law (UNCITRAL).
  • The theme of the UNCITRAL Academy Conference was “Embracing Global Change, Navigating New Possibilities”.
