Context
The U.S. Supreme Courtโs ruling in the Andy Warhol Foundation for the Visual Arts Inc. v/s Goldsmith et al. Case.
Copyrights
- Copyright is a collection of legal rights extended by law to an intellectual property owner.ย
- It provides a set of exclusive rights for artists over their creative output.
- Copyright law protects the work of diverse artists which include creators of literary, dramatic, artistic works, and musicals, photographers and the producers of cinematographic films and sound recordings.ย
- The extent of rights includes control over the manner in which others reproduce or modify the work of copyright holders.ย

Exemptions from infringement liability
- The copyrights are usually balanced with the rights of the users with the help of exceptions mentioned under the copyright laws and different jurisdictions follow different approaches to exceptions.
- European Nations: These nations, particularly the countries in continental Europe, have followed an โenumerated exceptions approachโ.
- As per this approach, an instance of copyright infringement in question must be specifically covered under the law in order to be considered an exception.
- The U.S.: Various other countries, including the U.S., have adopted an โopen-ended approachโ.
- There is no need to specify exemptions beforehand. However, guidelines are in place that mention the types of uses that can be exempted.
- The courts in the U.S. usually take into account four key factors while determining a copyright infringement case, they are:
- Purpose and character of the use (courts have usually given the highest priority)
- Nature of the copyrighted work
- Amount and substantiality of the portion taken by the defendant
- Effect of the use on the potential market of the plaintiffโs work
- The open-ended approach ensures that there is a considerable amount of flexibility to deal with challenges that arise due to emerging technologies.
- However, a major limitation is that it is hard to predict whether an activity will be exempted from copyright infringement liabilities until it undergoes a litigation procedure.

Andy Warhol Foundation for the Visual Arts Inc. v/s Goldsmith et al. Case (AWF case)
- Lynn Goldsmith, who is well known for her concert and portrait shots, had photographed the famous musician Prince in 1981 and one of these photographs was licensed by the Vanity Fair magazine for use as an โartist referenceโ in 1984.
- Lynn Goldsmith was paid $400 for the licence by Vanity Fair.
- The licence had particularly mentioned that the illustration could appear once as a full-page element and once as a one-quarter-page element, in their November issue of 1984.
- The magazine then hired Andy Warhol, a famous visual artist to work on the illustration.ย
- Andy Warhol came up with a silkscreen portrait of Prince using Goldsmithโs photograph.ย
- This silkscreen portrait, then, appeared in the magazine with appropriate credits to Lynn Goldsmith. However, Andy Warhol created 13 such screen prints and two pencil sketches, while the licence had authorised only one illustration.ย
- In 2016,ย a media conglomerate that publishes Vanity Fair, approached the Andy Warhol Foundation (AWF) to reuse the 1984 illustration and upon realising that there were more portraits available, they opted to publish one of them and they paid $10,000 to AWF as part of the license and nothing to Lynn Goldsmith.
- Realising that Lynn Goldsmith might file a copyright infringement suit, AWF filed a suit to declare that it had not committed infringement.ย
- Lynn Goldsmith later filed a countersuit accusing AWF of copyright infringement.
Observation of various courts in the AWF case
- A district court had ruled in favour of the AWF and it observed that Andy Warholโs use of Lynn Goldsmithโs photo constituted fair use.ย
- According to the court, Andy Warholโs work was โtransformativeโ as it had a different character, gave Goldsmithโs photograph a new expression, and used new aesthetics with creative and communicative results distinct from that of Goldsmithโs.
- The court also noted that Warholโs work added something new to the world of art and the public would be deprived of this contribution if the works could not be distributed.
- The Court of Appeals, however, reversed these observations and said that Warholโs use of the photograph did not constitute fair use.ย
- The case ultimately ended up in the Supreme Court of the U.S. and it gave its final verdict on May 18, 2023.
- The majority of judges opined that if an original work and secondary work have similar purposes and if the secondary work is of a commercial nature, then the factor of โPurpose and character of the useโ would not favour a fair-use interpretation unless there are other justifications.
- The majority of the judges, in this case, felt that both Goldsmithโs photos, as well as Warholโs adaptations, had more or less the same purpose.
- They held that while copying may have helped convey a new meaning or message, that in itself did not suffice to grant exemptions from copyright infringement liabilities.
Implications of the Judgment
- The U.S. Supreme Courtโs judgement is bound to create ripples across the field of visual arts.
- This decision is also expected to impact the manner in which regenerative artificial intelligence (AI) tools, such as ChatGPT have been conceived.ย
- Such regenerative AI tools are trained in a manner to use various texts, photos, and videos from the internet without considering whether they are copyrighted or not.
- The observations made on the issue of the commercial nature of the use might also lead to a deviation from the established view.
Implications for Indian copyright law
- Experts feel that there might not be any direct impact on Indian copyright law, as the framework for granting exceptions is different in India.ย
- India has adopted a hybrid model of exception, according to which, a copyrighted work is exempted for specific purposes mentioned under Section 52(1)(a) of the Copyright Act of 1957.ย
- India has a long list of exceptions mentioned and the decision of the U.S. Supreme Court could influence the courts while determining the โfairnessโ of litigation.

The Arab League:
- Founded in 1945, the Arab League is a loose alliance of nearly two dozen Arab countries that have pledged to cooperate on economic and military affairs, among other matters.
- Arab League currently has 22 member states โ Algeria, Bahrain, Comoros, Djibouti, Egypt, Iraq, Jordon, Kuwait, Lebanon, Libya, Mauritania, Morocco, Oman, Palestinian Authority, Qatar, Saudi Arabia, Somalia, Sudan, Syria, Tunisia, United Arab Emirates and Yemen.
- The League makes decisions on a majority basis, but there is no mechanism to compel members to comply with resolutions.ย
- It has been criticised for its internal conflicts and collective inaction on important international issues.ย

- The 32nd Arab League was recently held after a long span of 12 years. After the event, the Jeddah Declaration was passed. It highlighted the problems faced by the Arab nations in the contemporary situation.ย
- It called for “stopping foreign interference in the domestic affairs of Arab countries and categorically rejecting all support for the formation of armed groups and militias.”
Saudi Arabia angle:ย
- Saudi Arabia shares a good relationship with China and both of them have worked closely on many fronts.ย
- China had played a very important role in normalising the relationship between Iran and Saudi Arabia.ย
- These particular incidents have strengthened the relationship between the two countries.ย
- With these developments, there is more likelihood of the ending of civil war in the Arab region of the continent.ย
- Md Salman has taken over the leadership of the Arab world which has been in a vacuum in the recent past.
- Chinese brokered deals with Saudi and Iran leading to the elevated status of the Chinese at the international level. It has also helped Saudi to follow autonomous international relations, which earlier were much influenced by the US.
- Re-engagement with Hamas has played an important role in the deradicalisation of Palestine.ย
- With global oil facing volatility, it is Saudi which stands in a better position to take advantage of such a situation.ย
- Saudi Arabiaโs economy grew at 8.4%, twice the growth of the economy of the UAE.

- India has a very high stake in this region. This region contributes to Indiaโs energy security and diplomatic manoeuvring.ย
- Deeper cooperation with the countries in this region can lead to better outcomes for India. It would lead to an incessant supply of energy which is necessary for Indiaโs growth story.ย

- India and Australia have several commonalities, which serve as a foundation for closer cooperation and multifaceted interaction, on lines similar to what India has developed with other Western countries.ย
- Both are strong, vibrant, secular and multicultural democracies. They both have a free press and an independent judicial system; the English language is an important link.
- India is Australiaโs largest export market for gold and chickpeas, the second-largest market for coal and copper ores and the third-largest market for lead and wool.
- Australia and India upgraded their bilateral relationship from a โStrategic Partnershipโ in 2009 to Comprehensive Strategic Partnership (CSP) in 2020.
- The Australian Government commissioned the India Economic Strategy to 2035 to define a pathway for Australia to unlock opportunities offered by Indian Economic growth.
- The India-Australia Economic Cooperation and Trade Agreement (“IndAus ECTAโ) was signed. It will lead to the expansion of trade and commerce between the two countries.
- India is the 9th largest trading partner of Australia. During 2021, bilateral trade in goods and services with India was US$ 27.5 billion, with exports of goods and services worth US$ 10.5 billion and imports of goods and services worth US$ 17 billion.

- The Indian Prime Minister, while addressing the Indian diaspora at an event held in Sydney, said that the foundation of India-Australia relations lies in mutual trust and respect.
- The Prime Minister of Australia described India as a โforce of global goodโ and a โbright spotโ in the world economy.
- Also during the event, Harris Park, which is a suburb in Western Sydney where the Indian community celebrates festivals and events such as Deepavali and Australia Day, was renamed โLittle Indiaโ indicating the strong bond between the two countries.
- The Prime Minister of India further noted that the strategic partnership between the two countries is constantly deepening.
- The bilateral trade between the two countries is expected to double in the next five years as the countries are working towards building resilient and reliable supply chains.

Context
During the upcoming inauguration of the new parliament building on the 28th of May 2023, the Prime Minister of India will install the historic โSengol Sceptreโ in the building.
Sengol Sceptre
- The term Sengol is derived from the Tamil word โSemmaiโ which means โRighteousnessโ.
- Sengol has an important place in Tamil culture as when a new king is crowned, he would be presented with a โsengolโ during the coronation ceremony as a symbol of the transfer of power.ย
- This practice has existed since the Sangam Age and finds mention in texts such as the Purananooru, Kurunthogai, Perumpaanatrupadai, and Kalithogai.ย
- The Sengol Sceptre was given by the British to Indiaโs first Prime Minister Jawaharlal Nehru and has been a significant historical symbol as it represents the transfer of power in 1947.ย
- Jawaharlal Nehru had consulted C. Rajagopalachari, the last Governor-General of India, who had informed him about a ceremony performed during the Chola dynasty, in which the transfer of power from one king to the other was sanctified and blessed by high priests.
- The Sengol was handed over to Indiaโs first Prime Minister Jawaharlal Nehru by Lord Mountbatten minutes before Nehru hoisted the National Flag and made his famous โTryst with Destinyโ speech on August 15, 1947.
- Sengol is a five-feet long intricately carved, unbending gold-plated silver sceptre.
- This sceptre has a finial of Nandi (divine bull deity) on top symbolising justice.
- This sceptre was specially commissioned by the Thiruvavaduthurai Adheenam.
- The golden sceptre which was studded with jewels was made by Chennai-based Vummidi Bangaru Chetty and Sons jewellers.

1. Global body keeps NHRC waiting over โpolitical meddlingโ
- The UN-recognised Global Alliance of National Human Rights Institutions (GANHRI) has deferred the accreditation of the National Human Rights Commission (NHRC) of India for the second time in 10 years.
- GANHRI has cited objections such as political interference in appointments, involving the police in probes into human rights violations, and poor cooperation with civil society for deferring the accreditation of the NHRC.
- GANHRI also cited other reasons such as a lack of diversity in staff and leadership, and insufficient action to protect marginalised groups.
- About seven human rights watchers and institutions had objected to NHRC’s accreditation and had raised concerns about the lack of independence, pluralism, diversity and accountability which are against the โParis Principlesโ or the United Nationsโ principles on the status of national institutions.
- The Paris Principles puts in place six key criteria which include autonomy from government; adequate powers of investigation; adequate resources; independence guaranteed by a statute or constitution; mandate and competence and pluralism for National Human Rights Institutions.
2. Independence of judiciary is part of basic structure of Constitution: SC
- The Supreme Court has said that the independence of the judiciary is part of the basic structure of the Constitution and without impartial and independent judges in the judiciary, justice, which is a preambular goal, would remain illusory.
- The court also held that judicial independence from the executive and the legislature requires the judiciary to also have a say in matters of finances.
- This judgment highlighted the crucial role played by the district judiciary in the justice administration system.
- Justice Narasimha noted that the district judiciary is the backbone of the judicial system and it is important to ensure that the district judges enjoy a certain level of security and economic independence.
- The judgment underlined the doctrine that the โjudiciary must possess the inherent power to compel payment of those sums of money which are reasonable and necessary to carry out its mandated responsibilitiesโ.
- This doctrine is essential to ensure the separation of powers and secure the independence of the judiciary.

3. India set to triple speed of its fastest supercomputers
- The Union Earth Sciences Minister has noted that India is set to scale up its supercomputing prowess significantly and will also install an 18-petaflop system.
- Flops or floating point operations per second indicate the processing speed of computers and one petaflop refers to 1,000 trillion flops.
- According to the Minster, the processing power to such a degree would help solve complex mathematical calculations and also help in weather forecasting.
- At present, Pratyush and Mihir, which are Indiaโs most powerful civilian supercomputers, are placed at the Indian Institute of Tropical Meteorology in Pune, and the National Centre for Medium Range Weather Forecasting (NCMRWF) in Noida, respectively.
- They have a combined capacity of 6.8 petaflops.
- They were made operational in 2018 at an investment of โน438 crores.
- The new supercomputers, which are yet to be named, are imported from French corporation, ATOS (an information technology service and consulting company).ย
- The Indian government had signed an agreement in December 2018 with France to procure high-performance computers worth โน4,500 crores by 2025.
- The new MoES computers are likely to cost โน900 crores.
- The fastest high-performance computing system in the world is currently housed in the Frontier-Cray system at Oakridge National Laboratory, in the US.
- ย This super counter has a peak speed of one exa-flop (about 1,000 petaflops).

- Marking 200 years since their arrival in Sri Lanka from southern India, the Malaiyaha Tamil community has sought greater recognition, political rights, and improved living and working conditions.
- Members of the marginalised Malaiyaha [hill country] Tamil community in Sri Lanka had moved from southern parts of India to work in the British-run plantations.
- The members of this neglected community have been struggling and are subjected to discrimination and exploitation. They have been demanding long-lasting solutions to their enduring problems.
- Close to about 1.5 lakh people from the community currently work in the tea and rubber estates of Sri Lanks which help bring significant foreign exchange to the country.
- A majority population of the community also work outside the plantation ecosystem, including as professionals across sectors.
- These estate-bound communities, residing in the Central, Southern and Uva part of Sri Lanka are among the poorest classes of the society.
- India has committed to extend financial assistance to construct about 14,000 houses in these estate areas, but there have been concerns over the slow pace of the project.
